Terms of sale
Draft for review
This page is being checked by a legal adviser before launch. Details shown [LIKE THIS] are still being confirmed. Questions in the meantime: hello@truckersofmzansi.co.za.These terms apply when you buy from Truckers of Mzansi: merchandise from the shop and the driver-number fee. They sit alongside the terms of use, and nothing in them limits your rights under the Consumer Protection Act (CPA) or the Electronic Communications and Transactions Act (ECTA). The seller is [REGISTERED NAME] (details on the supplier information page).
1. Who can buy what
You need an account with a confirmed email address to place an order. Some items are only for drivers whose documents we've verified, or who have a confirmed driver number, or who have earned a particular achievement. Each item's page says what it needs, and checkout won't let you order something you don't qualify for.
2. Prices
Prices are in South African rand and are the prices shown when you place the order. We aren't registered for VAT, so no VAT is added. Delivery is extra and shown at checkout before you confirm. A promo code is applied at checkout if it's valid; it can't be added afterwards.
If we make an obvious pricing mistake, we'll tell you before you pay and you can cancel without cost.
3. Placing an order
When you place an order you get an order reference (for example TOM-4HP7W), our bank details and a pro-forma invoice by email. The order is an offer to buy. The agreement is concluded when we confirm your payment.
We hold the stock for your order while you pay.
4. Paying by EFT
- Pay by EFT using your order reference as the payment reference, so we can match your payment.
- Pay within 7 days. We send one reminder about 2 days before the deadline. Unpaid orders expire after the deadline and the stock is released.
- You can upload a proof of payment on the order page. It helps us find your payment sooner, but an order is only paid once the money shows in our bank account. Payments between different banks can take up to two working days to show.
- If you pay less than the order total, we'll contact you; the order isn't confirmed until the full amount is received.
- We never ask you to pay into a different account by email, SMS or phone. If anyone does, it isn't us: email hello@truckersofmzansi.co.za.
5. Personalised items
Some items are made with your driver number, name or other details you give us. Check those details before you order: we make them exactly as given. Because they're made for you, the seven-day cooling-off right doesn't apply to them (ECTA section 42). You still have all your rights if they're faulty. See returns and refunds.
6. Delivery
We start making or packing your order after payment is confirmed. Delivery options, fees and times are on the delivery page. Items are our responsibility until they're delivered to you.
7. Cancelling
- Before you pay: cancel a shop order from its page in your account, at no cost. A driver-number invoice you don't want to pay simply expires after its deadline.
- After you pay: you can cancel within seven days of receiving non-personalised items (cooling-off). See returns and refunds.
- We may cancel an order and refund you in full if an item can't be supplied, or if the order breaks the terms of use (for example, an achievement claimed on false evidence). We'll tell you why.
8. The driver-number fee
The registration fee is once-off: R450.00. It covers your driver number, one number badge with your number embroidered on it, and courier delivery of the badge to an address in South Africa. You only pay after we've verified your documents. We then email an invoice that works like any other order: pay by EFT within 7 days using its reference. Your number is confirmed in your name once payment is confirmed. If the invoice expires unpaid, the number is released. Refunds: [NUMBER FEE REFUND POLICY].
9. Invoices and records
Your pro-forma invoice is attached to the order email and can be downloaded from the order page. Your account keeps the full history of each order. You can download all your data from your account settings at any time.
10. Problems and complaints
Email hello@truckersofmzansi.co.za with your order reference. If we can't resolve it, you can contact the Consumer Goods and Services Ombud or the National Consumer Commission. Our alternative dispute resolution scheme: [ALTERNATIVE DISPUTE RESOLUTION SCHEME, OR "NONE"].
11. Law
These terms are governed by South African law.
